Section 201 or “safeguard” actions are designed to provide a temporary “safeguard” in order to facilitate positive adjustment of a domestic industry to import competition. “Positive adjustment” in the law means the ability of the industry to compete successfully with imports after termination of the safeguard measure, or the industry’s orderly transfer of resources to other productive pursuits; and the ability of dislocated workers to transition productively.

Safeguard measures restrict imports of a product temporarily if a domestic industry is seriously injured or threatened with serious injury caused by a surge in imports. Global safeguard investigations do not require the finding of unfair trade practice. The relief provided under this law is temporary in order to provide the industry with time to adjust to import competition. The President determines whether to provide relief.

Section 201 of the Trade Act of 1974 allows companies and industries to petition the U.S. International Trade Commission (ITC) that their industries are being unfairly harmed by foreign products. On January 23, 2018, the President issued Presidential Proclamation 9693 and Presidential Proclamation 9694 imposing tariff rate quotas and increased duties on imports of solar cells and panels, and washing machines and parts, effective February 7, 2018. The safeguard measures include tariff rate quotas.  A tariff rate quota permits a specified quantity of merchandise to be imported at a reduced duty rate during a specified period.  For example, the tariff rate quota on solar cells allows importations of a specified quantity of solar cells at no additional duty.   After this specified quantity of solar cells is imported, additional duty is imposed on the over quota imports. These duties are eligible for drawback refunds if the products are exported. These duties are eligible for drawback refunds if the products are exported.
